Low Income Taxpayer Clinic

Are you getting letters from the IRS? Is the IRS holding your tax refund? Do you owe the IRS money?

Attorneys at the Low Income Taxpayer Clinic (LITC) offer tax advice and representation to low-income New Yorkers who are having problems with their federal income taxes.

 

What the Clinic Does

  • Answer income tax questions
  • Resolve back tax issues
  • Stop tax collection (liens, levies and garnishments)
  • Help obtain a missing tax refund
  • Help with Internal Revenue Service (IRS) audits or exams
  • File appeals and Tax Court petitions
  • Request relief where it would be unfair for you to be responsible for paying taxes owed by your spouse
  • Get back refunds applied to your spouse’s debt
  • Appeal denials of tax credits such the Earned Income Tax Credit (EITC)
  • Restore NYS driver’s licenses suspended for unpaid income taxes
  • Advocate to resolve systemic tax issues that affect low-income and English as Second Language (ESL) taxpayer
  • Assist with identity theft involving income tax returns
  • Other issues with the Internal Revenue Service (IRS) and NYS Department of Taxation and Finance

The Clinic can also provide representation in disputes with the IRS, advice and consultations about federal and New York State income tax matters, educational presentations to community groups about income tax and taxpayer rights, options and responsibilities.

After you call, a Client Service Coordinator may arrange for an interview, or we may you find you a volunteer attorney to represent you.

We never charge a fee for our services. However, you may have to pay court costs and filing fees.

 

Independent

Although the clinic receives funding from the Internal Revenue Service (IRS), the clinic, its employees, and volunteers are not affiliated with the Internal Revenue Service (IRS) or the New York State Department of Taxation and Finance (DTF). Receiving help from the LITC will not affect your rights before the IRS.

 

Confidential

What you tell LITC attorneys is confidential. Even if you don’t qualify for help from the LITC, the information you tell us is confidential.

The clinic does not generally provide tax return preparation services. We can provide interpretation for all languages.

The services are delivered by attorneys employed by the Legal Aid Society of Northeastern New York or by private attorneys through the Legal Aid Society’s Private Attorney Involvement program.
